1. About these Terms

These Terms of Service ("Terms") govern your use of selph.nz and your purchase of a Selph Skin Strategy Report or any related service ("the Service"). The Service is provided by Manawanui Ventures Ltd, trading as Selph ("Selph", "we", "us", "our"), a New Zealand registered company.

By purchasing or using the Service, you agree to these Terms. Where our Privacy Policy or Medical Disclaimer are published on selph.nz, they form part of these Terms and should be read alongside them. If you do not agree, please do not use the Service.

2. What Selph provides

Selph produces a personalised, educational Skin Strategy Report based on the information you provide through our questionnaire (and any photos you choose to share). A report is a one-time digital document delivered to you electronically. We may also offer a Progress Review, which revisits your skin against a previous report.

Selph is independent. We do not sell skincare products, we do not earn commissions, we do not own or operate a clinic, and we do not refer you to specific businesses. Our recommendations describe ingredient types, approaches, and questions to ask — not specific products to buy.

3. Selph is guidance, not medical care

The Service is educational and is not a medical diagnosis, medical treatment, or a substitute for professional medical or dermatological advice. Using the Service does not create a clinician–patient relationship. If your report identifies something that needs medical attention, it will say so and direct you to an appropriate professional.

4. Eligibility

You must be 18 years or older to use the Service. By purchasing, you confirm that you are.

5. How the Service works

1. You complete the Selph questionnaire and may optionally upload photos.
2. You pay for your report (see Section 6).
3. Your report is prepared using the Selph clinical framework — a methodology developed and maintained by a qualified New Zealand dermal therapist, applied with the assistance of AI — and delivered to the email address you provide.

Your report is only as accurate as the information you give us. Providing incomplete, inaccurate, or misleading information will affect the guidance you receive. You are responsible for the accuracy of what you submit.

6. Pricing and payment

The current price for a Skin Strategy Report is shown on selph.nz at the time of purchase, which is the authoritative source for current pricing. Prices are in New Zealand dollars (NZD). Selph is not currently registered for GST, so no GST is added.

Payment is processed securely by our payment provider, Stripe. We do not receive or store your full card details. Your purchase is complete when payment is confirmed.

7. Refunds and cancellations

Because each report is a custom digital document prepared specifically for you, our refund position is:

• Before your report has been prepared: if you change your mind, contact us at hello@selph.nz and we will refund you in full.
• After your report has been delivered: refunds are not generally available, because the report has been created specifically for you based on your own information and cannot be returned or resold.
• If something goes wrong on our end — for example, a technical failure means you never receive your report, or the report was not prepared with reasonable care and skill — contact us and we will put it right, including a refund where appropriate.

Nothing in this section limits your rights under the Consumer Guarantees Act 1993, which cannot be excluded by these Terms.

To request a refund or raise a concern, email hello@selph.nz with your order details. We aim to respond within 2 business days.

8. Your report — use and intellectual property

Your report is provided for your personal, non-commercial use. You may keep it, print it, and share it with your own GP, dermatologist, or clinic.

You may not resell, republish, redistribute, or commercially exploit your report or any part of the Selph framework, templates, or content. Selph retains all intellectual property rights in its framework, methodology, report structure, and content. You receive a personal licence to use your own report; you do not acquire ownership of the underlying Selph materials.

9. Third-party products, treatments, and clinics

Your report may describe categories of products or types of professional treatment relevant to your concerns. Selph does not supply, endorse, or guarantee any specific product, brand, clinic, or practitioner. Any decision to purchase a product or undergo a treatment is yours, made at your own risk, and any resulting relationship is between you and that third party.

10. Disclaimers and limitation of liability

The Service is provided on a reasonable-efforts basis. To the maximum extent permitted by law:

• we do not warrant that the Service will be uninterrupted, error-free, or suitable for every individual circumstance;
• we are not liable for any decision you make, or action you take or do not take, in reliance on your report;
• we are not liable for any indirect, incidental, or consequential loss; and
• our total aggregate liability to you arising out of or in connection with the Service is limited to the amount you paid for the report giving rise to the claim.

Consumer rights. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot lawfully be excluded.

11. Acceptable use

You agree to use the Service lawfully and honestly, not to submit another person's information without their authority, and not to attempt to disrupt, reverse-engineer, or misuse the Service or its underlying systems.

12. Privacy

We handle your information in accordance with our Privacy Policy, which explains what we collect, how we use and protect it, who helps us process it, and your rights under the Privacy Act 2020.

13. Changes to the Service and these Terms

We may update the Service or these Terms from time to time. The "last updated" date above shows when these Terms last changed. The Terms that applied at the time of your purchase govern that purchase.

14. Governing law

These Terms are governed by the laws of New Zealand, and you and Selph submit to the non-exclusive jurisdiction of the New Zealand courts.
